Terms of Use

These terms are an agreement between you and FamilyCue. By downloading, creating an account or using the app, you agree to them. If you do not agree, please don't use FamilyCue.

Who can use FamilyCue

You must be at least 18 years old to create an account and be responsible for a household. Adults in a household may add family members, including children, and are responsible for the information they enter about them and for having the right to enter it.

Your account and household

You are responsible for keeping your login details and your household join code private. Anyone approved into your household can see every event, family member, checklist and photograph in it. Approve join requests only from people you trust.

You are responsible for activity that happens under your account. Tell us at support@familycue.app if you believe your account has been accessed without permission.

Acceptable use

You agree not to:

  • Upload content that is unlawful, abusive, or that you have no right to share.
  • Upload photographs of other people's children without their parent's consent.
  • Attempt to access another household's data, probe or interfere with the service, or reverse engineer the app.
  • Use FamilyCue to send spam or to harvest other people's personal information.

We may suspend or terminate accounts that breach these terms, where practical after giving notice.

Your content

The events, members, checklists and photographs you add are yours. You grant us only the limited permission needed to store, process, back up and display that content back to your household so the app works. We do not sell it, use it for advertising, or use it to train models.

Reminders, notifications and third-party services

FamilyCue is a planning aid, not a guaranteed alerting system. Reminders and notifications depend on your device, your operating system settings and third-party services such as Apple and Google push notification systems and, if you enable weather, Open-Meteo. Those services can be delayed or unavailable and are outside our control. Do not rely on FamilyCue alone for anything safety-critical, medical or time-critical.

Availability and changes

We work to keep FamilyCue available and accurate, but we may change, suspend or retire features, and the service may be interrupted for maintenance, outages or reasons beyond our control. We may update these terms; if a change is material we will make a reasonable effort to notify you in the app or by email, and continued use after that means you accept the updated terms.

Disclaimer of warranties

To the fullest extent permitted by law, FamilyCue is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted or error-free operation. We do not warrant that data will always be available or free of loss.

Limitation of liability

To the fullest extent permitted by law, FamilyCue and its team will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of data, loss of profits, loss of goodwill, missed events or appointments, or costs arising from a missed reminder — even if we have been advised of the possibility of such damages.

We take security seriously and use industry-standard measures to protect your data, but no online service can be guaranteed completely secure. To the fullest extent permitted by law, we are not liable for unauthorised access to, alteration of, or disclosure of your data resulting from a security incident, a breach at a third-party provider, or access gained through your own account credentials or an approved household member.

Where liability cannot be excluded, our total aggregate liability to you for all claims relating to FamilyCue is limited to the greater of the amount you paid us for the service in the twelve months before the claim, or USD 50.

Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud, or rights you have as a consumer under mandatory local law.

Indemnity

You agree to indemnify and hold FamilyCue harmless from claims, damages and reasonable costs arising out of content you upload or from your use of the app in breach of these terms or of applicable law.

Ending your use

You can stop using FamilyCue at any time and delete your account from inside the app or by requesting deletion through this website. Deletion is described in our Privacy Policy. Sections that by their nature should survive — including content ownership, disclaimers, limitation of liability and indemnity — continue to apply after your account ends.

Governing law

These terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict of laws rules, and the courts located there will have jurisdiction, unless mandatory law in your country of residence gives you the right to bring proceedings locally.
